These Terms & Conditions apply to your use of DaaTrade.com and to the sourcing and export services offered through it. Please read them before submitting a buying requirement or contacting our export desk.
1Who we are
DaaTrade.com ("DaaTrade", "we", "us", "our") is the export platform of DaaGroup, Pakistan. In these terms, "you" means any person or business that uses the website or our services, including international buyers and Pakistani suppliers.
2Accepting these terms
By using DaaTrade.com or submitting any inquiry, requirement or registration, you agree to these terms. If you are acting for a company, you confirm that you are authorised to accept these terms on its behalf. If you do not agree, please do not use the website.
3Our services
DaaTrade operates as an export desk, not as an open marketplace or product directory. Depending on the requirement, our services may include product sourcing, supplier matching, sample arrangement, quality inspection support, export documentation, logistics coordination, OEM and private label facilitation, and export consultancy.
The website does not sell products directly. No purchase is made by browsing the website or submitting a form.
4Buying requirements and quotations
- Submitting a buying requirement is a request for information. It does not create an order or a binding contract for either party.
- Quotations, prices and availability shared by our export desk are indicative unless they are confirmed in writing as a firm offer with a stated validity period.
- Until an order is confirmed in writing, prices may change with raw material costs, exchange rates, freight rates and government levies.
5Orders and contracts
Every transaction is governed by a separate written agreement, such as a sales contract or a proforma invoice accepted by both parties. That agreement sets out the product, specification, quantity, price, Incoterms, payment terms, delivery schedule and the parties to the transaction. If it conflicts with these terms, the written agreement prevails.
Depending on the transaction, DaaTrade, a DaaGroup company or a verified supplier may act as the seller. The written agreement will state who the seller is.
6Samples
Samples may be free or chargeable, and courier costs are paid by the buyer unless agreed otherwise. A sample represents the product type and grade being offered. Minerals, salt and agricultural products are natural materials, so some variation in colour, size and composition between a sample and a bulk shipment is normal. Acceptable tolerances should be written into the contract.
7Product information
Product descriptions, images and specifications on the website are for general information. They are not an offer and may not reflect the exact grade, packaging or origin available at a given time. The specification that applies to an order is the one confirmed in the written agreement and, where agreed, in a laboratory analysis or inspection certificate.
8Quality inspection
Pre-shipment inspection by an independent inspection company can be arranged on request. Unless agreed otherwise, inspection costs are paid by the buyer, and the inspection certificate issued at loading is accepted as evidence of quality and quantity at the time of shipment.
9Documentation, imports and compliance
We assist with the export documents required from Pakistan, such as commercial invoices, packing lists, certificates of origin and, where applicable, phytosanitary or fumigation certificates.
The buyer is responsible for import permits, licences, registrations, duties, taxes and compliance with the laws of the destination country. Both parties must comply with applicable export control and sanctions laws, and we may decline any requirement that would breach them.
10Shipping, delivery and risk
Delivery terms, the point at which risk passes, and responsibility for freight and insurance are set by the Incoterms stated in the written agreement. Shipping dates are estimates. We are not responsible for delays caused by carriers, port congestion, customs inspections or other events outside our control.
11Payments and fees
Payment terms, such as advance payment, letter of credit or documents against payment, are agreed in writing for each transaction. Any sourcing, service or consultancy fees are agreed with you in writing before the work starts. Bank charges are paid as stated in the agreement.
12Suppliers
Pakistani suppliers are reviewed before being introduced to buyers, including checks on production capability and export experience. This review reduces risk but cannot guarantee a supplier's future performance. Where DaaTrade is not the seller, the supplier is responsible for the goods it supplies under its contract with the buyer, and our role is limited to the services we agreed to provide.
13Use of the website
When using DaaTrade.com, you agree not to:
- submit false or misleading information;
- use the website for any unlawful purpose;
- attempt to gain unauthorised access to the website or its systems;
- copy or scrape website content in bulk; or
- send spam or unsolicited promotions through our forms.
14Intellectual property
The DaaTrade name and logo, and the design, text and images on this website, belong to DaaTrade or its licensors. You may view and print pages for your own business use. You may not copy, republish or use them commercially without our written permission.
15Personal information
We use the information you submit through the website, such as your name, company, email address and phone number, to respond to your inquiry and provide our services. We do not sell your personal information. We share it with suppliers, inspection companies, freight forwarders or banks only where this is needed to handle your requirement.
16Limitation of liability
The website and its content are provided "as is". To the extent permitted by law, DaaTrade is not liable for any indirect or consequential loss, including loss of profit, business or goodwill, arising from use of the website or reliance on its content. Our liability for any transaction is limited to the terms of the written agreement for that transaction.
17Force majeure
Neither party is liable for a failure or delay in performance caused by events beyond its reasonable control, including natural disasters, epidemics, war, government action, strikes, port closures or transport disruption.
18Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they were last changed. If you continue to use the website after a change, you accept the updated terms. The terms in force when a written agreement is signed apply to that agreement.
19Governing law and disputes
These terms are governed by the laws of Pakistan. Any dispute will first be discussed in good faith. If it cannot be resolved, it will be referred to the courts of Lahore, Pakistan, unless the written agreement for a transaction specifies another method, such as arbitration.
